These Terms of Service ("Terms") govern your use of the VoiceBros platform (voicebros.com and associated services). By accessing or using VoiceBros, you agree to be bound by these Terms. If you do not agree, you may not use the platform.

1. Acceptance of Terms

By registering for an account, accessing, or using VoiceBros, you accept these Terms in their entirety. We reserve the right to modify these Terms at any time. Continued use of the platform following notification of changes constitutes acceptance of the modified Terms.

2. Account Registration and Responsibilities

2.1 Account Creation

You must be at least 18 years old to create an account. You agree to provide accurate, complete, and current information during registration. You are solely responsible for maintaining the confidentiality of your account credentials and password.

2.2 User Responsibilities

  • You are responsible for all activity that occurs under your account.
  • You must notify us immediately of any unauthorized access to your account.
  • You agree not to use another person's account without permission.
  • You are responsible for maintaining the security of your login credentials.

3. Platform Role and Services

VoiceBros operates as a marketplace that connects buyers seeking voice-over services with professional voice-over artists. We provide the platform, tools, and payment infrastructure to facilitate transactions between parties. VoiceBros is not a party to transactions between buyers and artists, nor are we responsible for the quality, legality, or timeliness of services provided.

Users are responsible for verifying that their counterparties can perform the services as agreed. We facilitate communication and payment but do not guarantee the performance of either party.

4. Payment Terms and Commissions

4.1 Processing

VoiceBros processes payments through PayTR (for Turkey) and Nestpay/ZiraatPay (for international transactions). By using the platform, you authorize these processors to charge your payment method for services rendered and platform commissions.

4.2 Platform Commission

VoiceBros deducts a platform commission from each transaction. The current commission rate is displayed on the platform before payment. Commission rates may change upon notice. Artists receive payment minus the commission and any payment processor fees.

4.3 Wallet System

Users may maintain a wallet balance for storing funds. Wallet balances are non-interest bearing and may be used for future transactions. Withdrawal terms are available in your account settings.

4.4 Payment Disputes

If you dispute a charge, you must contact us within 30 days of the transaction. We will investigate and resolve disputes in accordance with applicable payment processor rules.

5. Refund Policy

  • Refunds are issued for service non-delivery or significant quality issues if agreed upon between buyer and artist.
  • Commission fees are non-refundable regardless of outcome.
  • Platform fees are non-refundable except where required by law.
  • Refund requests must be submitted within 30 days of the transaction.
  • VoiceBros retains the right to deny refund requests that violate these Terms.

6. Intellectual Property and Content Rights

6.1 Voice Recording Ownership

Upon full payment for a voice-over service, ownership of the resulting voice recording transfers to the buyer. The buyer may use the recording for the agreed-upon purpose. The artist retains no rights unless explicitly agreed otherwise in writing.

6.2 Platform Content

VoiceBros owns all rights to the platform interface, design, code, and technology. You grant VoiceBros a non-exclusive, royalty-free license to use your profile information and testimonials for marketing purposes, unless you opt out in your account settings.

6.3 User Content

You retain ownership of content you upload (scripts, recordings, profiles). By uploading, you grant VoiceBros a worldwide license to store, display, and process your content as necessary to provide services.

7. Content Guidelines and Prohibited Use

You agree not to use VoiceBros to:

  • Violate any applicable laws or regulations.
  • Create, upload, or request content that is illegal, defamatory, obscene, or sexually explicit.
  • Harass, threaten, or abuse other users.
  • Impersonate another person or misrepresent your identity.
  • Engage in fraud, money laundering, or financial crimes.
  • Infringe on intellectual property rights of third parties.
  • Attempt to gain unauthorized access to the platform or other users' accounts.
  • Upload malware or any code intended to damage the platform.
  • Engage in spam, phishing, or other malicious activities.
  • Circumvent payment processing or manipulate commission calculations.

VoiceBros reserves the right to remove prohibited content and suspend or terminate accounts that violate these guidelines.

8. Limitation of Liability

VOICEBROS IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, VOICEBROS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

VOICEBROS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

YOUR EXCLUSIVE REMEDY IS TO DISCONTINUE USE OF THE PLATFORM. In no case shall VoiceBros' total liability exceed the amount paid by you in the 12 months preceding the claim.

9. Dispute Resolution

9.1 Mediation

If a dispute arises between you and another user or VoiceBros, you agree to first attempt resolution through direct communication. If unresolved within 30 days, either party may request mediation through VoiceBros' dispute resolution system.

9.2 Arbitration

Any unresolved dispute shall be submitted to binding arbitration under Turkish law. Each party bears its own costs unless otherwise determined by the arbitrator.

10. Termination

You may terminate your account at any time by contacting us. VoiceBros may suspend or terminate your account immediately if you violate these Terms, engage in fraudulent activity, or for any reason with 30 days' notice.

Upon termination, your right to use the platform ceases, but you remain liable for any outstanding obligations or disputes initiated before termination.

11. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of Turkey, without regard to conflict of law principles. You irrevocably submit to the jurisdiction of the courts of Turkey for any disputes arising from these Terms.
